GENERAL TERMS AND CONDITIONS TO PARTICIPATE IN THE BREWERY TOUR
Preamble
The Service Provider produces alcoholic products (beer) on a commercial basis in the course of its economic activity. Within the framework of its activities, the Service Provider provides an opportunity to take a guided tour of the brewery used for the production of beer and to get to know the brewing process in a so-called Distillery tours (hereinafter referred to as referred to as the Service or Distillery Tour) for persons who purchase tickets for this on the Website in accordance with the provisions of the present General Terms and Conditions (hereinafter referred to as: GTC).
We would like to draw the attention of the Users to the fact that the area of the brewery is an industrial area and due to the protection of an operating plant, the production process, persons and property, Visitors can be excluded from the Brewery Tour at any time if the leader of the Brewery Tour deems that their exclusion is justified due to the GTC. The instructions of the leader of the Distillery Tour must be followed by the participants of the Distillery Tour.
Participants of the Brewery Tour are required to appear at the brewery 10 minutes before the start time of the Brewery Tour.
Please note that the purchase of tickets for the Distillery Tour does not include a table reservation in the Taproom, if the Customer wishes to stay in the Taproom after the Distillery Tour, please do so by indicating intention to reserve a table at the following number: +36-30-144-8404

- Acceptance of this General Terms and Conditions
- This GTC contains the rights and obligations of the Service Provider and the users of the services (hereinafter referred to as referred to as: User, Customer or Visitor) in relation to the Services.
- By purchasing a ticket, User accepts this GTC and the provisions of the Privacy Policy concerned as binding on themselves. If a ticket is purchased by a User for several people, the Visitors participating in the Distillery Tour accept this GTC and the provisions of the Privacy Policy by participating in the Distillery Tour.
- Ticket sales are carried out in accordance with the rules of distance contracts, through a device enabling communication between people at a distance. In the course of the conclusion of a contract between distance parties, the contract is concluded within the framework of a distance sales system, without the simultaneous physical presence of the parties, by using a device that allows the contracting parties to communicate exclusively between distance parties in order to conclude the contract. According to this GTC, ticket sales concluded through the Website mean the conclusion of an electronic, online contract, i.e. the sale takes place online through the system of the Website on the one hand, and messages sent to the e-mail address of the User as customer on the other. A service sales contract concluded online qualifies as an electronic commerce service, which is regulated by Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services (hereinafter referred to as: “Elkertv.”).
- By entering the Website or placing an order, the User declares that they are at least 18 years of age and that they fully familiar with and accept the limitations of online shopping.
- Range of Services available on the Website
- On the Website, tickets for guided Brewery Tours in English or Hungarian valid for a specific time may be purchased. As an additional service to the Tickets for the Brewery Tours a service may be purchased, which consists of a tasting of a semi-finished product and a free glass of beer in the Taproom.
- The purchase price of the Services is always the gross purchase price indicated next to the given Service, in Hungarian Forints, or Euros, which includes value added tax (VAT). The Service Provider shall not be liable for the price incorrectly indicated despite its care, or due to the fault of the system, or for an obviously erroneous, unrealistic price (HUF 0) that differs significantly from the well-known price of the Service. In such cases, the Service Provider is not obliged to provide the Service at the price incorrectly indicated on the Website. In the event of an incorrect price, the Service Provider offers the opportunity to purchase the Service at the actual price in the order confirmation or thereafter, with which information the User can decide whether they wish to order the given service at the actual price.
- A User may purchase more than one ticket but shall not be entitled to resell the tickets.
- The Service Provider is entitled to unilaterally change, expand or reduce the Services, content and functions available on the Website, and to introduce new ones. The Service Provider informs the Users about the availability of new Services, functions and contents on the Website.
- The ticket purchase process

- If the Customer wishes to purchase a ticket for a Distillery Tour, the purchase process may be started by placing the desired tickets in a virtual shopping cart by pointing the cursor to the time of the Distillery Tour on the data sheet and clicking the “Add to Cart” button, or by clicking on the “Add to Cart” button on the right side, after selecting the data sheet. After that, the Customer will receive a pop-up confirmation of the ticket(s) placed in the shopping cart and can choose the next steps by clicking on the “Continue to Cart” or “Continue Selecting” buttons.
- By clicking on the cart icon of the horizontal main menu, the Customer can view the tickets placed in the shopping cart during the purchase, as well as their total quantity and purchase price. During the purchase, the Customer can continuously check the contents of the shopping cart, with special regard to the quantity of each ticket, which can also be modified or deleted as required.
- The Customer can complete the purchase by clicking on the cart icon of the horizontal main menu with the “Checkout” or “Cart” buttons, or by clicking on the “Proceed to the Checkout” button from the shopping cart, and thus start finalizing the conclusion of the sales contract (hereinafter referred to as: Sales contract) on the Checkout page, where the clicking on the “Proceed to the Checkout” button redirects him/her.
- On the “Cart” page the Customer also has the opportunity to delete, or change the quantity of the tickets to be ordered (the current quantity is automatically updated and modified).
- After clicking on the “Proceed to Checkout” button, the Customer has the opportunity to enter the data required for invoicing and select the payment method.
- In order to complete the purchase, during the process of concluding the Sales contract, the Customer may make a bank card payment using the Barion system, by clicking on the “Continue to payment methods” button on the summary page of the Checkout page, and then selecting the payment method.
- Then, by clicking on the “Order summary” button, the Customer has the opportunity to view the details of the order in total. If the Customer do not find the data to be adequate, they may correct those by clicking on the “Modify” option of each menu item. If the Customer finds all the data correct, they may finalize the order by clicking on the “Order” button. A further condition for the conclusion of the Sales contract is that the customer also confirms that they have read the privacy policy, accepted and acknowledged this GTC, and that they are over 18 years of age by ticking the related checkboxes. If the Customer wishes to finalize the order, they may do so by clicking on the “Order” menu item.
- The Sales contract shall be concluded exclusively upon receipt of the confirmation of the order sent by the Service Provider to the e-mail address provided by the Customer during the order process (hereinafter referred to as: Confirmation). The Confirmation contains the date and language of the Distillery Tour, the number of tickets, the method of payment chosen by the Customer, the total price of the tickets and the Order ID. Until the Confirmation is received, the Sales Contract is not concluded, i.e. the Service Provider is not obliged to present the Brewery Tour, while the Customer does not become entitled to participate in the Brewery Tour. In this case, the Service Provider shall refund the reservation fee corresponding to the price of the purchased tickets already paid by the Customer (including the fees charged by Barion).

- The Customer shall have the opportunity to select the payment method during the process of concluding the Sales contract, under the “Payment” tab Online (credit card) payment with Barion.
- If the Customer has selected the option of online payment, the payment process will start on the Website, after selecting the “Online (bank card) payment with Barion” button, during the order summary, after clicking on the “Order” button.
- Barion is an online payment solution developed and operated by Barion Payment Zrt. (Cg. 01-10-048552, registered office: H-1117, Budapest, Irinyi József utca 4-20. 2nd floor). The Customer using the service may select Barion’s simple and secure payment solution for online purchases. In this case payment maybe processed in the usual way on the Barion interface through bank cards issued by Mastercard, VISA, MAESTRO, American Express, Google Pay, Apple Pay, or even with a Barion balance preloaded in the registered Barion account. The Customer does not need a registered Barion account to complete the payment, and it is not necessary to create a Barion account to make purchases on the Website.
- The Customer may complete the purchase of the Service(s) by selecting the Barion option upon the time of payment on the “Checkout” page, abd entering the bank card data on the Barion Website, or by selecting the Barion account payment option. With the bank card saved in the Barion branch, the Customer can pay quickly and securely on the Website, without re-entering the card details, using the Barion login data. By clicking on the “Online (bank card) payment with Barion” button on the “ Checkout” page, if the Customer selects the Barion bank card payment option, they shall be redirected from the Website to the Barion payment page, where they may enter the bank card details. If the Customer has a card registered in the Barion application, they can also choose it to make the payment. After entering the card details, we kindly ask the Customer to check the correctness of the data. After that, the transaction is processed in the bank’s processing systems, the Customer will also be notified of the payment result by e-mail, and the Barion system will redirect the customer back to the Website of the Website.

- The Service Provider shall issue an invoice for the tickets sold in accordance with Act CXXVII of 2007. The invoice issued by the Service Provider is an accounting document, which is fully suitable for identification regulated by accounting and tax legislation, is fully suitable for tax administration identification, and is handed over to the Customers in paper form after the order is placed.
- In respect of each Sale contract concluded online, the price of the purchased tickets, the payment method and the payment deadline shall be indicated on the invoice issued by the Service Provider. The Service Provider shall issue an invoice for the tickets ordered in accordance with the legislation in force. It is the sole responsibility of the company represented by the Customer to record all data relating to it – in accordance with reality – for the invoice to be issued, including the deduction of VAT. In case of failure to do so, or in case of incomplete or incorrect recording, the Service Provider shall not be obliged to issue a new or corrective invoice. By accepting this Sales Contract on behalf of the company represented by the Customer, the Customer irrevocably and definitively waives the right to issue a new or corrective invoice to the fullest extent permitted by law. The Service Provider excludes liability for damages arising from invoices that are unsuitable for exercising tax deduction rights due to the provision of incorrect, incomplete, or erroneous data, and the company represented by the Customer shall bear full liability for such damages.
- Withdrawal, Disqualification, Liability
- The Customer is entitled to cancel the Distillery Tours within 24 hours prior to the date of the Distillery Tour by sending an electronic message to the Service Provider to the e-mail address [email protected] (hereinafter referred to as: Withdrawal by Customer). In this case, the Customer may choose (i) to rebook for another available date within 3 months offered by the Service Provider in a reply e-mail, or (ii) the price of the tickets to be refunded, provided that only the amount of the ticket prices indicated in the Webshop may be refunded, whereas no other fees applied by Barion during the payment process may be refunded. In case of cancellation within 24 hours, the Service Provider is not obliged to refund the price of the tickets. In case of Withdrawal by the Customer, the Customer may indicate their bank account number in the canceling e-mail, to which they requests the refund.
- At the time indicated in the Confirmation, the Service Provider may to start the performance of the Service for the Visitor(s) presented, while the Visitor(s) who are late for the time indicated in the Confirmation may not join the Distillery Tour afterwards. In this regard, the Visitor shall not be entitled to enforce any claims against the Service Provider.
- The Service Provider is entitled to cancel the Distillery Tour for any reasons hindering the operation of the brewery by sending an electronic message (hereinafter referred to as: Withdrawal by Service Provider) to the e-mail address of the Customer provided by the Customer during the order process. In the cancellation email, the Customer who purchased the ticket must also be notified of the possible new booking date(s) and informed that if they do not wish to book a new date, they may choose to have the price of the purchased tickets (including the fees charged by Barion) refunded. In case choosing the refund, the Customer may provide the bank account number to which the refund is requested in a reply email. In case the Withdrawal by Service Provider falls within 1 week prior to the Brewery Tour, the Service Provider provides the Customer with a one-time 10% discount on consumption in the Gravity Taproom and a one-time 5% discount on the price of bottled beers purchased in the Gravity Taproom. If the Withdrawal by Service Provider falls within 48 hours, the Service Provider provides a one-time discount of 20% on consumption in the Gravity Taproom, and a one-time discount of 5% on the price of bottled beers purchased in the Gravity Taproom. Discounts cannot be used for purchasing merchandise products.
- In case of choosing a refund, the Service Provider is obliged to make the refund to the bank account specified by the Customer within 10 days of the bank account provided by the Customer.
- Visitors participate in the Brewery Tours organized by the Service Provider at their own risk; they are obliged to fully comply with the safety instructions of the Distillery Tour Guide. If the Visitor ignores such safety instructions, the Visitor may be excluded from further participation in the Brewery Tour. In such cases, the price of the tickets cannot be refunded, and the Customer may not claim compensation, indemnification or any other payment from the Service Provider on any grounds.
- The Service Provider is entitled to refuse to present the Service to a person who:
- appears under the influence of alcohol or other substances at the location of the Service,
- or aggressive behavior towards staff or other Visitor(s). In this case, the possibility of a refund of the Purchase Price is excluded.
- The Service Provider shall not be liable for any pecuniary or non-pecuniary damages arising in connection with the Service, except for damages caused intentionally, through gross negligence or criminal acts, or for breach of contract causing harm to life, physical integrity or health.
- The Visitor shall be obliged to compensate the Service Provider for any damage caused intentionally, by gross negligence or by criminal acts caused at the location of the Service.
- People under the age of 18 may only participate in the Brewery Tour with parental supervision. Visitors are fully responsible for any damage caused by them or by people under their supervision during the participation in the Brewery Tour. With regard to the fact that pursuant to Section 16/a of Act CLV of 1997 on Consumer Protection, it is prohibited to sell or serve alcoholic beverages to a person under the age of 18, therefore any such persons shall not be entitled to purchase the additional alcoholic services.
- The Service Provider does not provide the location of the Service as a venue for bachelorette parties or bachelor parties.
- Visitors may primarily submit their complaints in writing directly to the Service Provider, who will do everything in its power to eliminate and remedy any violations. The Service Provider and the Visitor shall primarily settle their legal disputes out of court, through negotiation. If the negotiation is unsuccessful, the Visitor may turn to the authorities, courts, or conciliation bodies in accordance with the applicable laws and the GTC.
- The conciliation body shall have jurisdiction over the out-of-court settlement of disputes between consumers and businesses concerning the quality and safety of products, the application of product liability rules, the quality of services, and the conclusion and performance of contracts between the parties (hereinafter referred to as consumer disputes): to this end, attempting to reach an agreement and, if this is unsuccessful, making a decision on the matter in order to ensure the simple, quick, effective, and cost-efficient enforcement of consumer rights. At the request of the consumer or the business, the conciliation body provides advice on the rights and obligations of the consumer. The condition for initiating proceedings before the conciliation body is that the consumer must first attempt to settle the dispute directly with the business concerned. Proceedings before the conciliation body are initiated at the request of the consumer. The request must be submitted in writing to the chair of the conciliation body. The conciliation body with jurisdiction over the Service Provider’s registered office is: Budapest Conciliation Body, 1016 Budapest, Krisztina krt. 99. Postal address: 1253 Budapest, Pf.: 10.
- This GTC shall be governed by Hungarian law, and the Hungarian authorities and courts shall have jurisdiction to adjudicate any disputes arising therefrom.
- If any provision of this GTC is invalid or becomes invalid, this provision shall not affect the other provisions of the agreement.
- The Parties shall communicate the notices in relation to the present GTC to each other in writing. Based on the agreement of the parties, communication by e-mail is also considered to be in writing.
The present GTC is valid for an indefinite period of time, valid from the date of publication on the Webshop until revoked.
