GENERAL TERMS AND CONDITIONS FOR ATTENDING THE BREWERY TOUR

Preamble

The Service Provider produces alcoholic beverages (beers) on a commercial basis. Within the framework of its activities the Service Provider provides the opportunity for guided tours of the brewery for the production of beer and the brewing process in the framework of so-called brewery tours (hereinafter referred to as: “Service” or “Brewery Tour”) to those who purchase a ticket for this purpose on the Website in accordance with the provisions of these General Terms and Conditions.

Users should note that the brewery site is an industrial area and a working plant, and for the protection of the production process, people and property, Visitors may be excluded from the Brewery Tour at any time if the Manager of the Brewery Tour considers that exclusion is justified for the above reasons. The instructions of the Manager of the Brewery Tour must be complied with by all participants in the Brewery Tour.

Participators of the Brewery Tour shall arrive at the Brewery ten minutes before the Brewery Tour.

Please note that the purchase of the ticket for the Brewery Tour does not include a reservation in the Taproom, if you wish to stay in the Taproom after the Brewery Tour, please call the following number: +36-30-144-8404

1. General information

2. Acceptance of General Terms and Conditions

2.1. These General Terms and Conditions (hereinafter referred to as: “GTC”) set out the rights and obligations of the Service Provider and the user of the services (hereinafter referred to as: “User”, “Customer”, or “Visitor”) in relation to the services.

2.2. By purchasing a ticket, the Users agree to be bound by these GTC and the Privacy Policy. If tickets are purchased by a User for more than one person, the Visitors participating in the Brewery Tour accept these GTC and Privacy Policy by participating in the Brewery Tour.

2.3. The sale of the tickets is carried out in accordance with the rules of contract between far away parties, by means of a device enabling communication between far away parties. During the conclusion of a contract between far away parties, the contract is established within the framework of a distance selling system, without the simultaneous physical presence of the parties, in order to conclude the contract by using a device that enables communication between far away parties only. Pursuant to this Contract in ticket purchasing transactions made through the Website, i.e. the purchase of the tickets takes place online through the Website on one hand, and on the other hand, via messages sent to your e-mail address as the Customer. The contract of sale of services cconcluded online is considered an electronic commercial service, which is defined and regulated in Act CVIII of 2001 on certain issues of electronic commercial services and services related to the information society (hereinafter: “Elkertv.”).

2.4. By entering the Website and placing and order the User declares 18 years of age or older, and full understanding and acceptance of the limitations of online shopping.

3. Services available on the Website

3.1. Tickets for guided Brewery Tours in English or Hungarian can be purchased on the Website for a specific date. Tickets for guided Brewery Tours can be purchased with and additional service consisting of tasting of semi-finished product and a complimentary pint of beer in the Taproom.

3.2. The purchase price of the products is always the gross purchase price indicated next to the product in Hungarian Forint or Euro, including added tax (VAT). The Service Provider shall not be liable for any incorrectly indicated purchase price, despite its due diligence and/or due to system error or for any obviously incorrect, unrealistic price (HUF 0), which differs significantly from the generally known purchase price of the product. In such cases, the Service Provider shall not be obliged to provide the product at the incorrectly indicated price on the Webshop interface. In the case of an incorrect price indication, the Service Provider shall, in the order confirmation or afterwards, offer the possibility of purchasing the service at the real price, in the possession of which information the User may decide whether he/she wishes to order the service at the real price.

3.3. One User may purchase more than one ticket but is not entitled to resell the tickets.

3.4. The Service Provider is unilaterally entitled to change, expand, reduce or introduce new Services, content and functions available on the Website at its own discretion. The Service Provider shall inform the Users of the availability of new Services, functions and content on the Website, including on the Website.

4. Process of ticket purchasing

4.1. If you wish to purchase a ticket for the Brewery Tour, you can start the purchasing process by moving the cursor to the date of the Brewery Tour on the data sheet, clicking on the “Add to Cart” button that appears, or by clicking on the “Add to Cart” button on the right hand side of the Service data sheet and placing the ticket in a virtual shopping cart. You will then receive a pop-up window confirming the tickets you have added to your shopping cart, and you can choose to proceed by clicking on the “Proceed to Cart” or “Continue Selecting” buttons.

4.2. By clicking on the shopping cart icon in the main horizontal menu, you are able to view the tickets placed in the shopping cart during the purchase, as well as their total quantity and purchase price. During the purchase, you are able to check the contents of the shopping cart at any time, particularly the quantity of each ticket, which you can modify or delete as required.

4.3. You can complete the purchase by clicking on the shopping cart icon in the main horizontal menu, and by clicking on the “Checkout” or “Cart” buttons, or from the shopping cart by clicking on the “Proceed to Checkout” button and thus start finalizing the purchase contract on the Checkout page, where clicking on the “Proceed to Checkout” button will redirect you.

4.4. On the “Cart” page you also have the option to modify the quantity of the Tickets you wish to order, to delete from them (which are automatically updated and modified after the quantity is changed and deleted).

4.5. After clicking on the “Proceed to Checkout” you have the opportunity to enter the data required for billing and to select the payment terms. 

4.6. During the sales contract process, on the Checkout’s summary page, click on the “Proceed to payment methods” button and select payment method by credit card using the Barion system. 

4.7. You can then click on the “Order Summary” button to view the order details entirely. If the data is incorrect, you are able to click on the “Modify’ option of each menu item to correct it. If all the data is correct, you are able to finalize the order by clicking on the “Order” button. As a further condition for the conclusion of the sales contract, you shall also confirm that you have read the data protection information, that you accept and acknowledge the General Terms and Conditions and that you are 18 years of age by ticking the relevant boxes. If you wish to finalize your order, you can do so by clicking on “Order”. 

4.8. The contract is concluded with the confirmation of the order by the Service Provider, which will be sent to the e-mail address provided by the Customer at the time of purchase, including the language of the Brewery Tour, the date of the Brewery Tour, the quantity of tickets, the method of payment chosen by the Customer, the total price of the tickets and the Order ID.

5. Process of payment

5.1. During the sales contract conclusion process, you have the option to select the method of payment. During the purchase process, under the “Payment” tab, you will have the possibility to choose the payment method (i) Online (credit card) payment with Barion.

5.2.If you have chosen the option of online payment, the payment process begins on the Website after selecting the “Online (credit card) payment with Barion” button, during the order summary, after clicking on the “Order” button.

5.3. The Barion Online Payment System is developed and operated by Barion Payment Zrt (company registration number: 01-10-048552; address of the registered office: 2nd floor, 4-20., Irinyi József street, Budapest, H-1117). Customers using the service can choose Barion’s simple and secure payment solution for online purchases. You can then make your payment as usual, on the Barion interface using your bankcard issued by Mastercard, VISA, MAESTRO or American Express, or using Goole Pay or Apple Pay, or even by using your prepaid Barion balance in your registered Barion account. Please note, that in order to complete your payment you do not need a registered Barion account and are not required to setup a Barion account to purchase in the Webshop.

5.4. You can proceed to the purchase of the Service(s) by selecting the Barion option on the Checkout page, by entering your bank card details on the Barion pages or by selecting your Barion account payment option. With the bank card saved in the Barion account, you can pay quickly and securely on the Website, without entering your card details again, using Barion login data. By pressing the “Order” button on the Order page, if you choose the Barion credit card payment option, you will be redirected from the Website to the Barion payment page, where you can enter your bank card details. If you have a card registered in the Barion application, you can also make the payment by selecting it. After entering your card details, please check that the details are correct. The transaction is processed in bank processing systems. You will also be notified of your payment result by e-mail and the Barion system will redirect you back to the Website page.

5.5. 5.6. The Service Provider shall issue an electronic invoice in accordance with Section 175 of Act CXXVII of 2007 on Value Added Tax. The invoice issued by the Service Provider is an accounting document, which is fully identifiable for accounting and tax purposes and is delivered to the Customer on paper at the time of order delivery.

5.7. The invoice issued by the Service Provider shall indicate the Purchase Price of the purchased tickets, the payment method and the payment deadline for all online Sales. The Service Provider shall issue an invoice for the tickets ordered, in accordance with the legislation in force. It is the sole responsibility of the Company that you represent to ensure that the invoice issued includes all the information relating to you, including any errors. Failure to do so, or incomplete or incorrect recording, shall not oblige the Service Provider to issue a new or corrective invoice. By accepting this Agreement on behalf of the Company represented by you, you irrevocably and definitively waive, to the fullest extent permitted by law, the right to issue a new or corrective invoice. The Service Provider shall not be liable for any damages resulting from the provision of incorrect, incomplete or incorrect information on an invoice which is not eligible for tax deduction, and which are the full responsibility of the company you represent.

6. Right of withdrawal, exclusion

6.1. The Customer has the right to cancel the Brewery Tour within 24 hours prior to the beginning of the Brewery Tour, by sending an e-mail to the Service Provider at info@gravitybp.com (cancellation). In this case, the Customer may choose (i) to book another (available) date within the 3-month period offered by the Service Provider in a reply e-mail, or (ii) to choose a refund of the ticket price, with the proviso that only the actual ticket prices indicated in the Webshop shall be refunded, however no refund of the additional fees applied by Barion during the payment process is possible. In case of cancellation by the Customer, the Customer may indicate in the cancellation e-mail the bank account number to which the refund is to be made. 

6.2. The Service Provider is entitled to cancel the Brewery Tour at any time for any reason that may prevent the operation of the Service Provider’s business by sending an e-mail (cancellation) to the e-mail address provided by the Customer at the time of ordering. In the cancellation e-mail, the Service Provider shall also inform the Users who have purchased the tickets of the possible new booking date(s) and shall inform the Customer that if they do not wish to book a new date, they may choose to request a refund of the price of the tickets purchased (including the fees charged by Barion). In case of opting for a refund, the Customer may reply by e-mail with the bank account number to which the refund is to be made. If the cancellation of the Brewery Tour is made by the Service Provider within 1 week prior to the Brewery Tour, the Service Provider will provide the Customer with a one-time 10% discount on the consumption in the Gravity Taproom and a one-time 5% discount on the price of the bottled beers purchased in the Gravity Taproom. If the cancellation of the Brewery Tour is made by the Service Provider within 48 hours, the Service Provider shall grant a one-time 20% discount on consumption in the Gravity Taproom and a one-time 5% discount on the price of the bottled beers purchased in the Gravity Taproom. Discounts cannot be used on merchandise.

6.3. If a refund is chosen, the Service Provider shall make the refund to the bank account specified by the User within 10 days from the date of the Customer’s bank account.

6.4. Visitors participate in the Brewery Tours organized by the Service Provider at their own risk and are obligated to fully comply with the safety instructions of the Brewery Tour Guide. In the event of any such safety instructions are disregarded by the Visitor, the Visitor may be excluded from the further participation in the Brewery Tour. In such cases, no refund of the price of the tickets may be requested, and the Customer may not claim any compensation, indemnity or other payment from the Service Provider.

6.5. People under the age of 18 may participate in the Brewery Tour only with parental supervision. Visitors are entirely liable for any damage caused by them, or any person under their supervision during their participation in the Brewery Tour. In view of the fact that the sale or service of alcoholic beverages to people under the age of 18 is prohibited under Article 16/a of Act CLV of 1997 on Consumer Protection, people under the age of 18 are not entitled to additional alcohol services.

7. Other provisions

7.1. Visitors may address their complaints directly to the Service Provider in writing in the first instance, and the Service Provider will do its utmost to eliminate and remedy any infringements. The Service Provider and the Visitors shall settle their disputes primarily out of court by conciliation. If the conciliation does not lead to a result, the Visitor may in accordance with the legislation force and the GTC, apply to the authorities, courts or conciliation bodies.

7.2. The conciliation body is competent to settle out of court any dispute between the consumer and the business (hereinafter referred to as: “consumer dispute”) concerning the quality and safety of product, the application of product liability rules, the quality of service, the conclusion and performance of a contract between the parties and to attempt to reach an agreement to this end, and if this is unsuccessful, to decide on the matter in order to ensure simple, quick, efficient and cost-effective enforcement of consumer rights. At the request of the consumer or the business, the conciliation body advises on the rights and obligations of the consumer. In order to initiate the conciliation body’s procedure, the consumer must attempt to resolve the dispute directly with the undertaking concerned. The conciliation procedure is initiated at the request of the consumer. The request must be made in writing to the chairman of the conciliation body. The competent conciliation body according to the seat of the Service Provider is the Conciliation Board of Budapest, Address: 310., III. em. 99. Krisztina krt. 7.3. These GTC shall be governed by the laws of Hungary and Hungarian law, and the Hungarian authorities shall have jurisdiction to settle any disputes arising therefrom. 

7.4. If any provision of these GTC is or becomes invalid, such provision shall not affect the other provisions of this Agreement.

7.5. The Parties shall notify each other in writing of their notifications in relation to these GTC. Any communication via e-mail shall be deemed to be in writing as per the agreement of the Parties.

These GTC shall be valid for an indefinite period of time, from the date of publication on the Portal until revoked.
